Accidents that occur offshore fall under a specific branch of personal injury law known as maritime law. These laws are designed to protect the rights of both maritime workers, as well as people who are hurt in recreational accidents (such as those hurt on personal watercraft).

For example, maritime workers who work in docks, harbors, and shipyards are protected by the Longshore & Harbor Workers’ Compensation Act (LHWCA), which is administered by the U.S. Department of Labor. This section of maritime law provides protection to more than 500,000 maritime workers, including protection for employment-injury and occupational-diseases.

To be eligible for the benefits offered under the LHWCA, maritime workers will need to pass a collection of tests to prove that the hurt individual was an employee who suffered injury while working upon navigable waters or in adjoining areas.

Other offshore workers are protected by the Merchant Marine Act of 1920-more simply known as the Jones Act. This is a U.S. federal statute that provides formalized protection for seamen injured while working offshore. Under this law, injured sailors (as well as their spouses and dependents) can file a lawsuit to recover damages; these damages can include maintenance and cure to cover wages, housing, and more.
