TOM PENNEKAMP JR
Tom Pennekamp, Jr. is the founding shareholder of Pennekamp Law, P.A. Prior to forming his boutique trial law and litigation firm, Mr. Pennekamp was a partner and shareholder with the firm of Grossman Roth, P.A. where he practiced complex personal injury and wrongful death trial law for 13 years. A desire to fulfill his own destiny and to provide select clients with a new generation of hands-on individualized attention to detail with traditional values of independence, integrity and honesty motivated him to open the doors of Pennekamp Law, P.A.
Tom’s law practice concentrates on auto accidents, aviation, maritime, product liability, medical malpractice, and catastrophic personal injury and wrongful death claims in both State and Federal Courts. He maintains an “AV” rating by the Martindale-Hubbell Law Directory. This is the highest attorney rating as voted by peers in the legal community for an attorney with very high to preeminent legal ability and ethical standards.
Tom has regularly handled many of the largest, most high profile and noteworthy personal injury cases in the State of Florida having consummated what is thought to be one of the largest individual personal injury settlements in Florida history, $17,500,000 for a man paralyzed in a SCUBA diving incident in Jamaica. In 2001, he was named one of South Florida’s Top “Up and Comer” Lawyers by Miami Metro Magazine’s South Florida Legal Guide. The Miami Today newspaper featured Tom as “The Newsmaker” in its August 2002 issue.
Coral Gables Magazine profiled him as one of its list of “21 People to Watch” in 2003. The Daily Business Review featured Mr. Pennekamp’s multi-million dollar award for an injured bridge tender after the collapse of the Flagler Street Bridge in its January 9, 2006 edition. Also in 2006, Super Lawyer Magazine recognized him as s Florida “Super Lawyers” ranking him in the top 5% of his peers. Most recently, the South Florida Business Journal honored him with its first “2006 Key Partners Award” in law.
Mr. Pennekamp’s major recoveries for families cover a broad range of serious personal injury and wrongful death matters. In the aviation arena, he has successfully represented victims in claims ranging from aircraft product liability to commercial airline disasters. His product liability actions include claims for a defective pressure relief valve causing an in-flight commercial jet explosion to a defective fuel system that led to a crash of a combat aircraft manufactured in Italy.
He represented the family of a crew member killed in the Million Air crash, the father of a child lost in the Value Jet disaster and a young man killed in an ultra-light crash in the Florida Keys. He also has represented victims in helicopter crashes, the American Airlines disaster as well as the crash that took the life of the young pop singer Aaliyah and her entourage in the Bahamas among other noteworthy aviation cases.
His product liability cases have included major personal injuries caused by defective bicycles; wrongful death tragedies caused by dangerously defective electronic sliding gates and vehicular rollover cases. He has also handled multiple claims for major personal injury involving bascule bridge defects and construction engineering and inspection failures in our transportation systems. These bridge cases alone resulted in a total of $12,000,000.00 in recoveries for the injured parties.
Additionally, Mr. Pennekamp has handled some of the largest and most complicated cases in South Florida courts for commercial marine and pleasure boat incidents. These lawsuits include notable cases such as the wrongful death suit against Fisher Island for a ferry collision, divers run over by a pleasure boat in Coconut Grove, personal water craft (Jet Ski) collisions and multiple claims against the cruise lines for a variety of negligent conduct causing serious injury and wrongful death to their passengers and crew members. Tom also has significant maritime law experience in limitation of liability actions, seaman claims and the Jones Act.
Tom’s achievements for his clients include outstanding recoveries in cases arising from construction accidents, trucking negligence, maintenance of traffic failures, auto accidents and insurance coverage disputes. He has obtained major recoveries for victims of dog attacks (one resulting in a confidential but multi-million dollar settlement), negligent security, and numerous complex medical malpractice actions in numerous medical specialties.
One of Tom’s present crusades in the medical field arises from the failure of many physicians to properly screen and test patients for colorectal cancer. This is an entirely treatable yet common disease. Medical negligence is this area of medicine is commonplace as the standards for screening and early detection are regularly ignored by primary care physicians and often not covered by health care providers. Mr. Pennekamp has successfully prosecuted a number of these cases on behalf of the victims and their families.
Tom Pennekamp is a Miami native (as are both his parents) and was born and raised in Coral Gables. His family has long and historic ties to our community. Tom is the grandson of John D. Pennekamp, namesake of the John Pennekamp Coral Reef State Park in Key Largo a man who is considered the father of the Everglades National Park. Tom’s father founded Pennekamp Insurance Agency (now known as Insource) and Tom worked in the insurance industry prior to embarking on his legal career in 1990.
Mr. Pennekamp was graduated from Dartmouth College in the Ivy League and completed his legal training at the University of Florida College of Law where he graduated with honors in the top 10% of his class as a member of the Order of the Coif. With an insurance background and a strong engineering aptitude, Tom gained a solid understanding of the law handling complex banking lawsuits and large commercial litigation actions early in his career with the former Mershon Sawyer Johnson Dunwody & Cole.
Tom is committed environmentally, professionally and personally. He is currently on the Board of Directors of the Friends of Florida State Parks and a founding member of the Friends of Bill Baggs State Park citizens support organization. Mr. Pennekamp is also a Past President of the Dade County Bar Association, Florida’s largest voluntary bar association with more than 4000 members and a past Chairman of the Florida Bar’s 11th Judicial Circuit Fee Arbitration Committee. His community activities include his membership on the Orange Bowl Committee and memberships in the Biscayne Bay Yacht Club.
